§11779. Penalties for
Class "A" Violations.
An
original violation of a child labor law, rule
or regulation designated as a class "A" violation
shall subject the employer, or responsible entity,
to a penalty assessment of $1,000.00. The second
citation for a class "A" violation shall subject
the employer, or responsible entity, to a penalty
assessment of $2,000.00. The third, and each succeeding
violation, shall subject the employer, or responsible
entity, to a penalty assessment of $5,000.00 for
the latter violation. Prior violations are such
that have not been contested, or that have been
upheld on proceedings thereon. In determining
penalty assessments, a citation will be considered
as referring to a single violation in the class
affected at the time the violation cited, regardless
of the number of minors in said group at such
time.
