s 115. Dredged, Spoil, and Waste Material.
(a) Dredged, spoil, or waste materials, regardless of their composition,
may not be deposited on the levee crown, levee slopes, or within the
limits of a project floodway without specific prior approval of the board.
(b) Suitable dredged, spoil, or waste material may be deposited on or
against the landside levee slope if the board determines that it is not
detrimental to the safety of the levee.
(c) Dredged materials must be drained of excess moisture before being used
as fill material.
(d) Dredged, spoil, or waste materials may not be deposited within the
limits of the stream channel, project floodway, or within a bypass area
without a determination by the board as to the effect of the deposition
regarding (1) the flood-carrying capacity of the stream channel, floodway,
or bypass; (2) recreational and environmental factors; and (3) fish and
wildlife.
