      s 1300.87. Civil Penalties.

      For purposes of section 1387 of the Health and Safety Code:

      (a) A violation that is ongoing and continuous is subject to a civil 
      penalty not to exceed two thousand five hundred dollars ($2,500) for each 
      day that the violation continues.

      (b) Each enrollee harmed by a violation of the Act constitutes a separate 
      and distinct violation subject to a civil penalty not to exceed two 
      thousand five hundred dollars ($2,500).
