      ARTICLE 1. GENERAL

      s 370.02. Eviction Policy.

      (a) Eviction of persons in occupancy as of the date of acquisition shall 
      be undertaken only for one or more of the following reasons:

      (1) Failure to pay rent, except in those cases where the failure to pay is 
      due to the lessor's failure to keep the premises in habitable condition, 
      is the result of harassment or retaliatory action or is the result of 
      discontinuation or substantial interruption of services;

      (2) Performance of a dangerous, illegal act in the unit;

      (3) Material breach of the rental agreement and failure to correct breach 
      within 30 days of notice;

      (4) Maintenance of a nuisance and failure to abate within a reasonable 
      time following notice;

      (5) Refusal to accept one of a reasonable number of offers of replacement 
      dwellings;

      (6) The eviction is required by State or local law and cannot be prevented 
      by reasonable efforts on the part of the public entity;

      (7) The building has structural defects existent at the time of purchase 
      by the Department.
