s 5427. Peer Review.

(a) Applications that have been determined eligible pursuant to Section
5425(b) shall undergo peer review by one or more persons with expertise in
the scientific and technological aspects of the project.

(b) The agency staff shall transmit each completed application to the
chair of the committee. Following consultation, to the maximum degree
feasible, with the chair, agency staff shall assign to one or two members
of the committee the task of conducting a peer review. If the agency
staff, after such consultation with the chair of the committee determines
that none of the members has sufficient expertise in the subject matter of
the project, or determines that no qualified member of the committee is
available to conduct a peer review, the agency staff shall engage a
consultant or consultants to perform the peer review.

(c) The peer reviewer(s) shall assess the scientific and technological
aspects of the project addressing the following questions:

(1) Are the scientific and engineering objectives of the project
reasonable?

(2) Are the technology transfer aspects of the project appropriate
and feasible?

(3) Are the project plans adequate to fulfill the project
objectives?

(4) Is the project likely to lead to commercialization of a
product(s), service(s) or process(es)?

(d) The reviewer[s] shall prepare a succinct report of their work,
including an affirmative or negative conclusion in the questions in
subsection (c) of this Section. Affirmative conclusions on all questions
shall be deemed to be a positive peer review. A negative conclusion on any
question shall be deemed a negative peer review. The reviewer(s) shall be
authorized to conduct oral reviews with applicants in connection with
questions in subsection (c) of this Section.
