s 20319. Division of Regional Library Networks.
(a) If a regional library network wishes to divide into two
or more
regional library networks, a notice of intent approved by
its regional
network council shall be filed with the state board no later
than
September 1 of the fiscal year immediately preceding the July
1 effective
date of the division. Regional library network affiliation
authorizations
approved by the institutional or public library jurisdictional
governing
body of each member of the new regional library networks,
and a new
regional library network plan as specified in Education Code
18840 for
each regional library network resulting from the division,
shall be filed
with the state board no later than January 15 of the fiscal
year
immediately preceding the July 1 effective date of the division.
(b) The state board's approval of requests for regional
library network
divisions shall be based on the criteria for the establishment
of regional
library networks specified in Section 20316 of this subchapter
and upon
the state board's determination that the division provides
at least as
effective a way of carrying out the purposes of the Act as
would be the
case if the division did not occur.
(c) For purposes of determining the eligibility of the regional
library
networks and their members to receive services and funds under
other
provisions of the Act, a division approved by the state board
shall be
considered effective beginning July 1 of the fiscal year immediately
following the fiscal year in which the division request is
filed. The
state board may approve an earlier effective date if it determines
that
such action would best serve the purposes of the Act.
